The Software, Web Content and any Documentation are provided “as is” without warranty of any kind, express or implied, including, but not limited to, warranties of performance or merchantability or fitness for a particular purpose. Beta User bears all risk relating to quality and performance of the Software.
Knowledge Rules Inc. does not warrant the level of performance of the Software or that earlier versions superseded by new versions (whether or not distributed or made available to the Beta User) will continue to be capable of access to and use with current versions of the Software. Knowledge Rules Inc. does not warrant that the Software or Web Content or the functions contained in the Software will meet the Beta User’s requirements, operate without interruption or be error free. Knowledge Rules Inc. is for informational purposes only, and makes no representation as to the accuracy, usefulness, safety, or intellectual property rights of or relating to site information.
This Agreement covers the use of Beta versions of the Software and contained Web Content. Beta versions of the Software and contained Web Content are known to contain errors. The Beta User of the Beta versions of the Software understands and accepts that there are risks involved in using Beta versions of software, and these risks are the sole responsibility of the Beta User.
Limitation of Liability. Beta User has no remedy for breach by Knowledge Rules Inc.; in no event will Knowledge Rules Inc. be liable for any lost profits or other monetary or non-monetary damages, including direct, indirect, incidental, special, consequential or any other type of damages, arising out of this Agreement or the use of the Software or Web Content licensed hereunder, even if Knowledge Rules Inc. has been advised of the possibility of such damages.
General Provisions
Terms and Termination. This Agreement and Beta User’s subscription to the Web Content may be terminated (i) by Beta User providing Knowledge Rules Inc. written notice of termination, (ii) by Knowledge Rules Inc., at its option, if Beta User commits any breach of the Agreement, or (iii) upon termination of the Knowledge Rules Inc. Beta period, as defined by Knowledge Rules Inc.. Upon any termination of this Agreement, Beta User must cease all use of the Software, destroy all copies of any portion of the Web Content or accompanying Documentation in its possession, or control and take such other actions as Knowledge Rules Inc. may reasonably request to ensure that no portions of the Web Content remain in Beta User possession or control.
Governing Law. This Agreement will be governed by and construed under the laws of the State of Pennsylvania, U.S.A.
General Provisions. Neither this Agreement nor any portion hereof may be assigned, sublicensed or otherwise transferred by Beta User. Should any provision of this Agreement be held to be void, invalid, unenforceable or illegal by a court, the validity and enforceability of the other provisions will not be affected thereby. Failure of a party to enforce any provisions of this Agreement does not constitute and should not be construed as a waiver of such provision or of the right to enforce such provision.
Special Beta User Conditions
You affirm that you are more than 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use. The Software and accompanying web content and documentation is not intended for persons under 18. Furthermore, you agree that your use of the Software will not violate the federal, state, or local laws for the community in which you use the Software. You will only use the Web Content for informational purposes.
You certify that you will respect the intellectual property and copyrights of Knowledge Rules Inc. and will uphold all copyright laws. You will use this information only for your own personal reference and will not use it for commercial purposes or gain.
As a Beta User, you are entitled to use the Software and accompanying Web Content on a limited basis, at no charge to you, during a Beta period. You may not have more than one User account with Knowledge Rules Inc.. The Beta Software may be taken out of service at any time. Under no circumstances shall your access to the Software under these terms extend beyond twelve (12) months.
You may be contacted by the Software authors via email or online surveys for feedback regarding the use of the Software. If you fail to respond to three consecutive inquiries your eligibility for continued use of the Beta Software may be dropped and your access to the Software will be terminated.
